OFFICIAL CONTEST RULES

These Terms and Conditions (“Terms”) govern the “Is It A Pro V1” golf ball giveaway contest (the “Contest” or “Giveaway”) operated by Is It A Pro V1 (“Sponsor,” “we,” “us,” or “our”), a TikTok channel based in Suwanee, Georgia. Contact: hey@itsaprov1.com.

BY ENTERING THIS CONTEST, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL DECISIONS OF THE SPONSOR, WHICH ARE FINAL AND BINDING IN ALL RESPECTS.

1. ELIGIBILITY

Who Can Enter

  • Must be a legal resident of the United States
  • Must be 18 years of age or older at time of entry
  • Must have a valid email address
  • Must provide accurate and complete entry information

Who Cannot Enter

  • Employees, officers, directors, and agents of Sponsor
  • Immediate family members (spouse, parents, children, siblings) of above
  • Household members of above individuals
  • Residents of states where prohibited by law
  • Anyone who has won a prize from Sponsor in the past 12 months
  • Anyone who has violated previous contest terms or engaged in fraudulent activity

Verification

Sponsor reserves the right to verify eligibility and disqualify any entrant who:

  • Provides false, incomplete, or misleading information
  • Cannot be contacted or fails to respond within required timeframes
  • Is found to be ineligible or in violation of these Terms

2. CONTEST PERIOD

Entry Period

All times are Eastern Time.

Entry Deadline

All entries must be received by the Contest end date and time. Entries received after the deadline will be disqualified. Sponsor’s computer clock is the official timekeeper.

3. HOW TO ENTER

Entry Method

  • Visit the official contest website
  • Complete the entry form with required information (name and email)
  • Submit the completed form during the Contest Period
  • One entry per person, per email address, per household

Entry Restrictions

  • Only one entry per person permitted
  • Multiple entries from the same person will result in disqualification
  • Use of automated entry systems, bots, or scripts is prohibited
  • Entries must be submitted personally by the entrant

Technical Issues

Sponsor is not responsible for:

  • Lost, late, incomplete, or misdirected entries
  • Technical failures, network congestions, or server issues
  • Any computer, phone, or technical malfunction
  • Inability to access the website or submit entries

4. PRIZE DETAILS

Prize Description

ONE (1) PRIZE PACKAGE CONSISTING OF:

  • Three (3) golf balls identified as Pro V1 golf balls
  • IMPORTANT: These are USED golf balls found on golf courses
  • Balls are in various conditions and may show wear, discoloration, or damage
  • No guarantee of playability, performance, or condition
  • Approximate retail value: $15.00 (based on used golf ball market value)

Prize Condition Disclaimer

WINNER ACKNOWLEDGES AND ACCEPTS:

  • Golf balls are USED and were found on golf courses
  • Balls may have scratches, scuffs, discoloration, or other wear
  • Balls may not be suitable for tournament or competitive play
  • No warranty or guarantee of condition, authenticity, or performance
  • Sponsor makes no representations about the balls’ history or previous use
  • Winner accepts prize “AS IS” without any warranties

Prize Limitations

  • No cash alternative or substitution allowed
  • Prize is non-transferable
  • If prize becomes unavailable, Sponsor may substitute with item of equal or lesser value
  • Winner is responsible for all taxes, fees, and costs associated with prize acceptance
  • Prize has no cash redemption value

5. WINNER SELECTION AND NOTIFICATION

Selection Process

  • One (1) winner will be selected via random drawing
  • Drawing will occur within 7 days after Contest Period ends
  • Selection will be conducted by Sponsor or its designated agent
  • Odds of winning depend on total number of eligible entries received

Winner Notification

  • Winner will be notified via email within 10 days of selection
  • Notification will come ONLY from an @isitaprov1.com email address
  • Winner must respond within 72 hours of notification
  • Failure to respond within deadline will result in forfeiture
  • Alternate winner may be selected if original winner doesn’t respond

Winner Verification

Before prize award, winner must:

  • Confirm eligibility and compliance with these Terms
  • Provide shipping address within the United States
  • Sign and return any required affidavits or releases
  • Provide identification if requested

6. PRIZE FULFILLMENT AND SHIPPING

Shipping Details

  • Prize will be shipped via USPS regular mail
  • Winner provides shipping address at their own risk
  • Shipping within the United States only
  • No expedited or insured shipping provided
  • Estimated delivery: 7-14 business days after winner confirmation

Shipping Risks and Limitations

SPONSOR IS NOT RESPONSIBLE FOR:

  • Lost, stolen, or damaged packages during transit
  • Delivery delays caused by USPS or other factors beyond Sponsor’s control
  • Incorrect addresses provided by winner
  • Packages delivered to wrong address due to winner’s error
  • Any costs associated with re-shipment due to delivery failures

Delivery Confirmation

  • Winner is responsible for monitoring delivery
  • Sponsor’s obligation ends when package is handed to USPS
  • No tracking or delivery confirmation provided unless requested at winner’s expense
  • Claims for lost or damaged shipments must be made with USPS

7. TAXES AND FEES

Winner’s Tax Responsibility

  • Winner is solely responsible for all federal, state, and local taxes
  • Winner will receive IRS Form 1099 if prize value exceeds $600
  • Winner should consult tax professional regarding tax implications
  • No tax advice provided by Sponsor

Additional Costs

Winner is responsible for:

  • All shipping and handling costs beyond basic USPS delivery
  • Any customs fees (if applicable)
  • Insurance costs (if desired)
  • Re-delivery fees for failed delivery attempts

8. PUBLICITY AND LIKENESS RIGHTS

Publicity Release

By entering, winner grants Sponsor the right to:

  • Use winner’s name, image, likeness, and biographical information
  • Use winner’s entry information and prize details
  • Create promotional materials featuring the winner
  • Publish winner information on social media, website, and other channels
  • Use winner’s testimonials or statements about the prize

Media Usage

  • No additional compensation for publicity use
  • Usage rights are perpetual and worldwide
  • Winner waives any claims related to publicity rights
  • Sponsor may choose not to use winner’s likeness at its discretion

9. LIABILITY LIMITATIONS AND DISCLAIMERS

Prize Condition Disclaimers

SPONSOR MAKES NO WARRANTIES REGARDING:

  • Condition, authenticity, or performance of golf balls
  • Suitability for any particular purpose or use
  • Merchantability or fitness for a particular purpose
  • The balls’ origin, history, or previous ownership

General Liability Limitations

SPONSOR IS NOT LIABLE FOR:

  • Any injuries, damages, or losses related to prize use
  • Golf balls causing injury during play or handling
  • Any defects, damage, or poor performance of prize items
  • Lost profits, consequential, or punitive damages
  • Any claims exceeding the actual prize value ($15.00)

Contest Operation Disclaimers

SPONSOR IS NOT RESPONSIBLE FOR:

  • Technical failures affecting contest entry or operation
  • Human error in contest administration
  • Printing, typographical, or other errors in materials
  • Unauthorized access to or alteration of entry information
  • Late, lost, misdirected, or incomplete entries

Maximum Liability

Sponsor’s total liability shall not exceed the approximate retail value of the prize ($15.00).

10. INDEMNIFICATION

By entering, you agree to indemnify and hold harmless Sponsor, its affiliates, employees, agents, and representatives from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your participation in the Contest
  • Your acceptance, use, or misuse of the prize
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any injury or damage caused by the golf balls

11. DISQUALIFICATION AND MISCONDUCT

Grounds for Disqualification

Sponsor may disqualify any entrant who:

  • Violates any provision of these Terms
  • Provides false or misleading information
  • Attempts to manipulate the entry process
  • Engages in unsportsmanlike conduct
  • Violates any applicable law
  • Attempts to damage or compromise contest integrity

Misconduct Consequences

  • Immediate disqualification from current and future contests
  • Forfeiture of any prizes won
  • Potential legal action for damages
  • Reporting to appropriate authorities if illegal activity suspected

12. MODIFICATION AND TERMINATION

Sponsor’s Rights

Sponsor reserves the right to:

  • Modify, suspend, or terminate the Contest at any time
  • Change these Terms with notice
  • Disqualify entries that don’t comply with Terms
  • Resolve disputes in its sole discretion
  • Investigate suspected violations or fraudulent activity

Force Majeure

If Contest cannot be conducted as planned due to:

  • Technical difficulties, fraud, or other causes beyond Sponsor’s control
  • Natural disasters, pandemics, or government regulations
  • Legal restrictions or court orders

Sponsor may modify, suspend, or cancel the Contest and select winners from eligible entries received before the issue occurred.

13. DISPUTES AND GOVERNING LAW

Dispute Resolution

Any disputes will be resolved through:

  1. Good faith negotiations between parties
  2. Binding individual arbitration (no class actions)
  3. Arbitration conducted in Georgia under American Arbitration Association rules

Governing Law

  • These Terms are governed by Georgia state law
  • Federal law applies where applicable
  • Georgia courts have jurisdiction for any legal proceedings

Class Action Waiver

By entering, you waive any right to participate in class action lawsuits or class-wide arbitration related to this Contest.

14. PRIVACY AND DATA USE

Information Collection

  • Entrant information is collected and used per our Privacy Policy
  • Information used solely for contest administration and winner notification
  • No sale or rental of entrant information to third parties

Communication Consent

By entering, you consent to:

  • Email communication regarding contest status and winner notification
  • Reasonable follow-up communication related to prize fulfillment
  • Inclusion in winner announcements and publicity materials

15. MISCELLANEOUS PROVISIONS

Severability

If any provision of these Terms is found invalid, the remaining provisions remain in full effect.

Entire Agreement

These Terms constitute the complete agreement between entrant and Sponsor regarding the Contest.

No Waiver

Sponsor’s failure to enforce any provision doesn’t waive its right to enforce that provision later.

Request must be received within 60 days after Contest end date.

16. ADDITIONAL TERMS AND WARNINGS

Golf Ball Safety Warning

IMPORTANT SAFETY NOTICE:

  • Used golf balls may have hidden damage or defects
  • Inspect balls carefully before use
  • Do not use damaged balls for play as they may cause injury
  • Use at your own risk

No Guarantee of Authenticity

  • While balls are identified as Pro V1s, Sponsor makes no guarantee of authenticity
  • Balls were found on golf courses and may be counterfeit or different models
  • Winner accepts this risk

Contest Sponsorship

This Contest is sponsored solely by Is It A Pro V1 and is not affiliated with:

  • Titleist or any golf ball manufacturer
  • Any golf courses where balls were found
  • TikTok, social media platforms, or website hosts
  • USPS or shipping companies

ACKNOWLEDGMENT

By entering this Contest, you acknowledge that:

  • You have read, understood, and agree to these Terms
  • You meet all eligibility requirements
  • You understand the prize consists of used golf balls with no warranties
  • You accept all risks associated with prize acceptance and use
  • You waive any claims against Sponsor related to the Contest or prize

These Terms are effective as of the date posted and remain in effect until the Contest concludes and all prizes are awarded.
